Mandated Paid Sick Leave on Denver Ballot
Denver employers and businesses not located in Denver but who have employees who work in the City of Denver need to weigh their support for or against Denver Initiative 300 on the ballot this fall. The initiative includes full time, part and temporary employees.
Initiative language includes Article VIII section 28-236 states (a) All employees who work in Denver for at least 40 hours in a year have the right to paid sick and safe time as provided in this Article.(b) All employers shall provide a minimum of one hour of paid sick and safe time for every 30 hours worked by an employee. Employers will not be required under this section to provide more than 72 hours of sick and safe time for an employee in a calendar year.
The complete text of Initiative 300 is linked here.
Currently, there are no federal legal requirements for paid sick leave. For companies subject to the Family and Medical Leave Act (FMLA), the Act does require unpaid sick leave. FMLA provides for up to 12 weeks of unpaid leave for certain medical situations for either the employee or a member of the employee's immediate family.
